Versus

1. Shri P. Dayanand Collector, Bilaspur, District : Bilaspur, Chhattisgarh

2. Fariha Alam Siddiqui Chief Exective Officer, Zila Panchayat Bilaspur, Chhattisgarh., District : Bilaspur, Chhattisgarh

3. Ajay Patel, Chief Executive Officer, Janpad Panchayat Pendra District- Bilaspur, Chhattisgarh., District : Bilaspur, Chhattisgarh ---- Respondents Shri B.L.Dembra, counsel for the petitioner/s. Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 28/02/2018 This contempt petition has been filed by the petitioner alleging willful disobedience of order passed by this Court on 13/11/2017 in WPS No.6002/2017. 2.

Learned counsel for the petitioner submits that on challenge made to the process of selection, an interim order was passed in favour of the petitioners that the process of recruitment initiated by the respondents in the writ petition under the advertisement dated 26/08/2017 shall not affect continuance of the petitioners and the posts against which they are working.

It is alleged that later on, a select list has been prepared by the Chief Executive Officer, Bilaspur which has been approved by the Collector in which, against the posts in which the petitioners are working, candidates have been selected for being appointed. 3.

Once this Court has directed that the process of selection shall not affect continuance of the petitioners and the posts against which they are working, no selected candidates could be approved for being posted at the places where the four petitioners are working and no select list against those posts could be prepared. Let the Collector, Bilaspur and Chief Executive Officer, Jila Panchayat, Bilaspur carry out necessary amendment in the select list, excluding the posts on which these four petitioners are working.

4.

Any appointments against the posts on which the petitioners are working, shall be treated as an act of willful disobedience of the order of this Court. A copy of this order be placed by the petitioners before the Collector, Bilaspur and Chief Executive Officer, Jila Panchayat, Bilaspur for necessary compliance. 5.

It goes without saying that if appropriate correction is not made out, the petitioners would be at liberty to revive the contempt petition. SD/- Sd/- (Manindra Mohan Shrivastava) Judge Deepti
