---- Petitioner

Versus

1. Municipal Corporation Raigarh Through : Commissioner, Raigarh, District Raigarh (Chhattisgarh).

2. Nazul Officer, Raigarh, District Raigarh (Chhattisgarh). ---- Respondents For Petitioner :

Mr. Amit Sharma, Advocate For Respondents :

Mr. Ashish Gupta, Panel Lawyer (Hon'ble Shri Justice Manindra Mohan Shrivastava) Order On Board By 10/02/2016 1.

The Petitioner has filed this petition seeking a direction to Respondents to consider the petitioner's claim for rehabilitation. 2.

Learned Counsel for the Petitioner submits that petitioner, though an encroacher, had occupied a piece of land and had constructed a temporary construction as dwelling house, has received a notice for demolition. He further submits that the Petitioner is not challenging the action of demolition or dispossession but he being land-less, house-less person belonging to poor strata of society, may be considered for allotment of land under beneficial Government Scheme providing small piece of land to land-less poor persons. 3.

On perusal, I find that the Petitioner has not submitted any application before any competent Authority to implement Government Scheme as stated above. No such Scheme has also been placed on record.

4.

In view of above circumstances, no specific direction can be issued. However, the Petitioner is at liberty to approach the competent Authority/Respondent's

Corporation with such a prayer for allotment of land under any existing Government scheme.

5.

The petition is dismissed with the aforesaid liberty. Sd/- (Manindra Mohan Shrivastava) Judge Rahul
