1. At the outset, it is brought to the notice of this Court that the petitioner had already filed an appeal. Therefore, learned counsel for the petitioner submits that as the appeal is pending, the petitioner may be permitted to withdraw this petition with liberty to prosecute the pending appeal.

2. Prayer is not opposed by learned counsel for the respondents.

3. In view of the above, this petition is dismissed with liberty to the petitioner to prosecute the pending appeal. The appellate authority shall do well to decide the appeal within a period of four months from the date of receipt of copy of this order.
