This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 69/2015, registered at Police Station Jaijaipur, District Janjgir Champa, C.G., for the offence punishable under Sections 304-B, 34 of IPC.

After hearing learned counsel appearing for the parties and taking into consideration the facts and circumstances of the case; nature and gravity of offence and death occurred within 11⁄2 months of marriage, this Court is not inclined to release the applicant on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.

Since four prosecution witnesses are examined, I deem it appropriate to direct the trial Court to expedite the trial and conclude it within a maximum period of six months from the date of receipt and/or production of certified copy of this order.
