(1) After hearing learned counsel appearing for the parties, I am of
the considered opinion that the order dated 7.4.2011 passed by Employees' Provident Fund Commisioner under Para-26B of the Scheme, 1952 is not appealable under Section 7-I of the Employees Provident Fund and Miscellaneous Provision Act, 1952 and, therefore, order dated 18.01.2016 passed in W.P. (L) No. 111 of 2014 deserves to be recalled and accordingly re-called.
(2) Consequently, W.P. (L) No.111/2014 is restored to its original number for hearing and disposal in accordance with law. Certified copy, as per rules.
