Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 04/04/2017 Heard.

1. By this petition, the petitioner has challenged the legality and validity of order dated 13.2.2017 by which petitioner's application for renewal of sawmill licence has been rejected.

2. Though number of grounds have been urged, learned counsel for the petitioner could not dispute the legal position that there exists an alternative and efficacious remedy of statutory appeal against the order.

3. In the absence of there being any extraordinary reason warranting interference by this Court without insisting on exhaustion of alternative remedy, I am not inclined to entertain the petition only on the ground that the petitioner has a remedy of filing appeal.

-24. The petition is therefore dismissed with liberty to file an appeal.

5. The period from the date of filing of the writ petition till the receipt of certified copy of this order shall be excluded from the purview of limitation in the matter of filing of appeal.
