The applicant has preferred this bail application as he has been arrested in connection with Crime No.52/2017, registered at Police Station Berla, District Bemetara (C.G.) for offence punishable under Sections 354, 354-A (I) (II), 341, 294, 323 IPC and Sections 7 & 8 of the Prevention of Children from Sexual Offences Act, 2012. 2.

Having seen the nature of allegations wherein the applicant not only outraged the modesty of the prosecutrix but had altercation and scuffle with her maternal uncle, who tried to intervene at the time of incident, the present is not a fit case for release of the applicant on bail.

Accordingly, prayer for grant of bail is rejected. However, the applicant would be at liberty to move again after examination of the prosecutrix.
