1. This contempt petition has been filed by the petitioner alleging willful disobedience of order dated 20.09.2016 by which, the respondents were directed to examine and take appropriate decision on petitioner's claim on parity for regularization in services on the basis of order passed by this Court in the case of Arun Meshram V. Chhattisgarh State Ware Housing Corporation and others in WPS No.4572 of 2014.
2. Learned counsel for the petitioner submits that though the representation was submitted way back on 05.10.2016, till date, no decision has been taken even though seven months have passed. Repeated representations were made, which have failed to evoke any response.
3. Though, this Court had not fixed any time limit for compliance of the
order of the Court, taking into consideration the nature of exercise required to be undertaken, nevertheless, the respondent authority cannot sit over the matter for indefinite period. Having considered that even after seven months, decision has not been taken by the respondent authority, which only reflects upon their reckless attitude towards compliance of the Court's order, this petition at this stage, is disposed off with the liberty to the petitioner to revive the contempt petition, if the decision is not taken by the respondent authority within a period of 45 days from the date of receipt of copy of this order. Nondecision in the matter as per the earlier order of the Court, shall be viewed strictly and appropriate proceeding may also be drawn by the Court if it is found that no steps were taken for compliance of the Court's order.
