Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 19/05/2017 Heard.

1. The applicant has been arrested in connection with Crime No.10 of 2017 registered in Police Station- Jainagar, District -Surajpur (C.G.) for the alleged commission of offence under Sections 354,354-A, 294, 452, 506, 323/34 of IPC and Section 8 of the Protection of Children from Sexual Offences Act, 2012.

2. Learned counsel for the applicant submits that the applicant has been falsely implicated and he did not commit any act of outraging modesty of the girl and he has been involved only because he was present along with the main accused Jim Singh.

3. On the other hand, learned counsel for the State opposed the bail application by submitting that according to the prosecution story, the applicant along with the other persons entered the house of the prosecutrix, outraged modesty and assaulted the family members.

4. Considering the aforesaid submission, at this stage, I am not inclined to grant bail to the applicant. The bail application is rejected. Sd/- (Manindra Mohan Shrivastava) Judge Rekha
