(2) Faced with the objection with regard to maintainability of the petition on the ground of existence of alternative remedy, learned counsel for the petitioner seeks to withdraw this petition with liberty to file appeal before the competent authority.

(3) The petition is accordingly dismissed as withdrawn with liberty to the petitioner to file appeal before the competent authority, raising all the grounds as are available to it under the law including the grounds raised in this petition. It is, however, directed that in case the petitioner prefers appeal within a period of 30 days from today along with

application for stay, the competent authority shall hear on the application for stay within 3 days from the submission of application of stay.

(4) Consequently, I.A. No.1 stands disposed of.
