The applicants have preferred this bail application as they have been arrested in connection with Crime No.36/2017, registered at Police Station Suhela, District Baloda Bazar - Bhatapara (C.G.) for offence punishable under Section 34 (2) of the Chhattisgarh Excise Act for illegally possessing 10.44 Litre of illicit country made liquor.

Having heard learned counsel for the parties, having regard to the facts and circumstances of the case and considering the fact that the applicants are in jail since 13.03.2017, this Court is

inclined to release them on bail. Accordingly, the application is allowed and the applicants are directed to be released on bail on their executing a personal bond for a sum of Rs.50,000/- each with two local sureties for a sum of Rs.25,000/- each to the satisfaction of the trial Court. The applicants are directed to appear before the trial Court on each and every date given by the said Court. It is made clear that if the applicants involve themselves in the offence of similar nature in future, this order granting bail to the applicants shall automatically stand cancelled without reference to the Bench.
