Heard Learned Counsel for the Petitioner and the State. 2.

On the own showing of the Petitioner, her application in response to the advertisement did not reach the authorities before the last date fixed. 3.

The argument of the Petitioner that she is not responsible for postal delay stands squarely answered in (2006) 12 SCC 561 (State of Bihar v. Amarendra Kumar Mishra) that postal delay cannot be considered an explanation to consider grant of relief on sympathy.

Even otherwise the advertisement was made on 28.5.2008 and the last date for submission of the application was 31.7.2008. Quite obviously appointments must have been made by now.
