This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.99/2015, registered at Police Station-Balrampur, District-Balrampur (CG), for the offence punishable under Sections 363, 366A & 376 of the IPC and Sections 3 & 4 of the Protection of Children from Sexual Offences Act.

After hearing learned counsel appearing for the parties, taking into consideration the facts and circumstances of the case and nature and gravity of the offence, the fact that the prosecutrix is said to be minor i.e.12 years on the date of commission of offence and the fact that after kidnapping the prosecutrix, rape is said to have been committed with her on 27.7.2015, I do not find any ground for grant of bail to the applicant. Consequently, bail application is rejected.
