Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 22/01/2016

1. This petition under Article 226 of the Constitution of India has been preferred seeking direction to the respondents to acquire the petitioner's land which has been used for construction of Bisunpur-Odgi Road (13 Km) Ambikapur, Surguja in accordance with law, conclude the land acquisition proceedings at the earliest and pay compensation to the petitioner together with damages for illegal use of the land.

2. Return filed by the respondents would indicate that the acquisition proceeding has already commenced by issuance of notification under the new Land Acquisition Act, 2013.

3. Considering the entire fact situation of the case, it appears, the writ petition has been rendered partly infructuous, therefore, the same is disposed of with a direction to the respondents to conclude the acquisition proceedings at the earliest, preferably within a period of 9 months from the date of submission of certified copy of this order before the Land Acquisition Officer.
