The petitioner by this petition has challenged the legality and validity of order dated 12.05.2017 by which the petitioner has been transferred from Kanker to Jamshedpur.

The grounds raised by the petitioner do not relate to either jurisdictional infirmity or any personal malice of the authority exercising power of transfer. In the absence of such allegation or any patent illegality or arbitrariness, instead of keeping this matter pending, it would be expedient in the interest of justice to dispose off this petition, at this stage, with a direction to the respondents to consider petitioner's representation in accordance with their own policy.

As there is a dispute whether the petitioner had actually submitted representation or not, without commenting upon the merits of the case, if the petitioner submits representation within a period of ten days from today, the same shall be considered and decided within a period of four weeks from the date of receipt of copy of this order. Since there was an order that no coercive steps shall be taken against the petitioner, as an ad-interim measure, it would be appropriate to continue the same for a period of four weeks.

The petition is disposed off.
