The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 265/2019 registered in Police Station Purani Basti, Raipur, District Raipur for offence punishable under sections 435, 436, 427, 34 of Indian Penal Code. 2.

The prosecution story, in brief is that, the complainant has lodged a report alleging that some rent articles were kept in his house situated at Malsai Pond, the applicant and other co-accused have set fire to the said articles thereafter they also set fire to Tata Vehicle bearing registration No.C.G. 04 J.D. 5244. Thereafter, offence has been registered against the present applicant and other co-accused persons. 3.

Learned counsel for the applicant submits that other co-accused Ankit Mishra has already been enlarged on bail in M.Cr.C. No.8203/2019 and allegation against the applicant is same as that of co-accused Ankit Mishra, therefore the applicant may be released on bail. 4.

Learned State counsel do not dispute the fact that other co-accused

Ankit Mishra has already been enlarged on bail in M.Cr.C. No.8203/2019, however she submits that against the applicant there are 8 criminal antecedents.

Considering the fact that other co-accused Ankit Mishra has already been enlarged on bail in M.Cr.C. No.8203/2019, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
