At the outset, learned counsel for the State submits that appellant A. Nainamma had died on 14.12.2012 during treatment from jail at Mecahara, Raipur for which the jail authorities have submitted a report.

Looking to the report it appears that the appellant died on 14.12.2012 and as no one applied for leave to continue the appeal, the appeal is abated on account of death of the appellant. 3.

Accordingly, the appeal is disposed of as the same is abated.
