This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.274/2015, registered at Police Station-Kotra Road, District-Raigarh (CG), for the offence punishable under Sections 420, 467, 478, 471, 419 & 120B/34 of the IPC and Section 66 (D) of the IT Act.

Case of the prosecution, in brief, is that the applicant and co-accused impersonating themselves as Manager of the State Bank of India, Central Branch obtained ATM code of the complainant and made on-line shopping and thereby committed the offence. 3.

Learned counsel for the applicant would submit the applicant has not committed any offence and he has falsely been implicated in crime in

question. He would submit that the applicant is in jail since 8.10.2015, charge-sheet has already been filed and no further custodial interrogation is required. Therefore, he may be released on bail. 4.

On the other hand, learned State counsel would oppose the bail application.

Taking into consideration the facts & circumstances of the case, nature & gravity of the offence and the manner in which the applicant and co-accused obtained ATM code of the complainant and made on-line shopping, I do not find any ground for grant of regular bail to the applicant. Consequently, bail application is rejected.
