3. Deputy Director Public Prosecution Baikunthpur, District Korea, Chhattisgarh ---- Respondents For Petitioner :

Mr. Ajay Shrivastava, Advocate For State-Respondents :

Mr. Kunal Das, Panel Lawyer Hon'ble Shri Justice Goutam Bhaduri Order On Board 13.02.2020

1. Grievance of the petitioner is that the petitioner was appointed as Assistant Grade-III on 15.10.2012 with a condition that first two years would be the probation period. It is stated that subsequently after completion of probation, 7 years have passed and though there is no complaint has been reported against the petitioner, the petitioner has not been regularized till date.

2. Learned counsel for the petitioner further submits that considering the conduct of the petitioner, the recommendation Annexure P-3 was made by the Deputy Director Prosecution on

03.11.2015 to the Director Prosecution to regularize the services of the petitioner and grant him regular pay scale, as prayed for in the application by the petitioner. The petitioner therefore submits that the representation of the petitioner, which has already been recommended by the Deputy Director Prosecution to the Director Prosecution by letter dated 03.11.2015 may be considered and the petitioner may be regularized.

3. Considering the limited grievance of the petitioner and after perusal of Annexure P-3, it appears that the petitioner has already filed an application for regularization, as he has successfully completed his period of probation. Having been completed such period of probation, if the representation of the petitioner is pending, the Director Prosecution is directed to decide the representation of the petitioner within a period of 60 days from the date of receipt of a copy of this order.

4. With the aforesaid observation, the petition stands disposed of. Sd/- (Goutam Bhaduri) Judge ashok
