Agrawal Order On Board 23/01/2018 (1) Learned counsel appearing for the petitioners would submit that these writ petitions were preferred by the petitioners on 12.01.2011, 24.02.2011, 02.08.2011 & 10.08.2011 and during the pendency of the instant petitions, the order dated 28.06.
2011 has been passed by the respondent authorities without hearing the petitioners and only hearing one Mr. Anil Kumar Rathore erstwhile owner, therefore in the interest of justice the respondent authorities may be directed to consider the case of the petitioners and pass order afresh after hearing the petitioners in accordance with law.
(2) The State counsel on instruction from Mr. Ashok Kumar Chandrakar, Joint Director, Urban Administrative Department, Regional Office, Raipur, who present in the Court would submit that proper opportunity of hearing will be provided to the petitioners before passing order and order will be passed afresh in accordance with law after hearing the petitioners.
(3) In view of the statement made on behalf of State Government, the instant writ petitions are disposed of with a direction to the respondent authorities to pass order afresh after hearing the petitioners in accordance with law by speaking and reasoned order expeditiously within a period of three months from the date of receipt of certified copy of this order.
