(2) Learned counsel appearing for the petitioner would submit that the petitioner has been transferred from Gunderdehi, District Balod to Bacheli, District Dantewada in the mid-time of academic session, by the impugned transfer order dated 04.02.2016 passed by respondent No.1/State Government and therefore, he may be permitted to make fresh representation before respondent No.1/State Government within a period of ten days from today.

(3) Prayer appears to be fair and reasonable.

(4) The petitioner is permitted to make fresh representation before respondent No.1/State Government. If such representation is made by the petitioner before respondent No.1 within a period of ten days from today and, in turn, respondent No.1 shall consider and decide the same on its own merit and in accordance with law preferably within a period of 21 days from the date of receipt of representation of the petitioner along with copy of this order.

(5) With the aforesaid observation, the petition stands finally disposed of. No order as to cost(s).
