1. This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.106/2019 registered at Police StationBirra, District Janjgir- Champa (C.G.) for the offence punishable under Section 20(B) of Narcotic Drugs & Psychotropic Substance Act.
2. As per the prosecution case, certain information was received by the police that some person was carrying Cannabis, raid was conducted wherein 4.500 Kg. Cannabis were recovered from the possession of the applicant.
3. Learned counsel for the applicant submits that the applicant is in jail since 25.12.2019, the charge sheet has already been filed, no further investigation is required, therefore, the applicant may be enlarged on bail.
4. Perused the case diary and the documents. The case diary shows that on
receipt of information raid was conducted and 4.500kg. of Cannabis was recovered.
5. Considering the quantity of Cannabis allegedly seized from the applicant, the charge sheet has been filed and the applicant is in jail since 25.12.2019, I am inclined to release the applicant on bail.
6. Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed. It is directed that the applicant shall be released on bail on furnishing a personal bond for a sum of Rs.25,000/- with one surety each in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed.
