This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 14/2016, registered at Police Station Kabir Nagar District Raipur (C.G.), for the offence punishable under Section 34(2) of the Excise Act.

After hearing learned counsel appearing for the parties and taking into consideration the facts and circumstances of the case; nature and gravity of offence; and particularly taking into

consideration the criminal antecedent of the applicant as 11 cases registered/pending by the Police Station Amanaka Raipur, this Court is not inclined to release the applicant on regular bail. 3.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
