1. Heard.

2. Learned counsel for the petitioner would submit that the petitioner was appointed on temporary basis on the post of Mitanin subsequently on clamping of certain allegations, the services of the petitioner were dispensed with in the year 2016. He would further submit that subsequent to the termination of the service an enquiry was conducted by the three members committee and the committee after enquiry gave a report to the CMHO Bilaspur, wherein no misconduct was found to be committed by the petitioner. It is contended that since the petitioner was terminated on the basis of allegations with a stigma and the enquiry committee having found that the petitioner has not committed any misconduct or dereliction of the duties, the report of the enquiry committee may

be considered and the petitioner's case for reappointment may be considered. Learned counsel for the petitioner would further submit that the petitioner has also made an application to the Collector, Bilaspur, which may be decided.

Having regard to the facts of this case and after perusal of the report of the three member committee, since the earlier representation is dated 03.12.2018 (Annexure P-3) considerable period has lapsed, the petitioner is given liberty to make afresh representation within a period of three weeks from today before the Collector Bilaspur and the said authority in turn shall consider and decide the representation, if so filed, within a period of three months from the date of receipt of the representation.
