1. Heard.

2. The applicant has preferred this application filed under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.18/2020 registered in Police Station Khadagwa, District Korea C.G. for the offences punishable under Sections 379, 411/34 of the IPC.

3. As per the prosecution case, applicant has committed theft of 200 litres of diesel from a truck bearing registration no. CG-04 MV-7114.

4. Learned counsel for the State would oppose the prayer.

5. Considering the entire fact situation of the case particularly for the reason that the applicant is in jail since 23.01.2020 and offence is triable by Judicial Magistrate First Class, this Court is inclined to release him on bail. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of ₹ 50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
