The applicant has preferred this third bail application filed under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.258/2015 registered in Police Station City Kotwali, District Dhamtari (CG) for the offence punishable under Sections 420, 409/34 & 120-B of the Indian Penal Code and under Sections 3, 4 & 5 of the Prize Chits and Money Circulation Schemes (Banning) Act. 3.
Two earlier bail applications of the applicant were dismissed on merits, however, as on 8-1-2019 when applicant's second
bail application was dismissed, a coordinate Bench has allowed bail application of a similarly placed co-accused namely; Vishnu Patel vide order dated 8-1-2019 in M.Cr.C.No.6917 of 2018. The said Vishnu Patel was allowed bail on the ground of length of pre-trial detention and for the reason that after examination of 35 witnesses additional charges were framed on 19-9-2018.

The ground on which Vishnu Patel has been enlarged on bail would apply to the present applicant also, who is the only accused in jail because other six co-accused persons have already been enlarged on bail by one or other coordinate Bench.

Considering the entire facts situation of the case, this Court is inclined to release her on bail. Accordingly, the application is allowed and the applicant is directed to be released on bail on her executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. She is directed to appear before the trial Court on each and every date given by the said Court.
