1. The challenge in the present writ petition is the illegality committed in the election held in the village panchayat : Rangitola, Block : Chhuriya, District: Rajnandgaon for the pose of Sarpanch in the recently held elections. The elections (voting) were held on 31.01.2020 and the results were declared on the same date.
-22. The alleged ground raised by the petitioner in the present writ petition is the illegal means adopted by the winning candidate in the election process.
3. Considering the facts of the case, particularly the fact that the election results have already been declared on 31.01.2020, this Court is of the opinion that the writ petition at this juncture would not be maintainable as the remedy available to the petitioner is for preferring an election petition under Section 122 of the Chhattisgarh Panchayat Raj Adhiniyam, 1993.
4. Reserving the right of the petitioner to avail the remedies available to him, the present writ petition accordingly, stands disposed off. Sd/- (P. Sam Koshy) Judge Rahul
