Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 09/08/2017 Petitioner's grievance is that the transfer order issued by the State Government on 30/07/2016, followed by strict direction issued on 03/12/2016 in the matter of implementation of transfer order is not being followed with the result that the petitioner, till date, has not been relieved. 2.

Learned Dy.A.G. submits that once there is an order of the State Government, all the subordinate officers are under an obligation to comply with the directions unless the order is already cancelled, varied or modified. 3.

In view of the statement made by learned Dy.A.G, this petition is disposed off with a direction to respondent no.2 to forthwith relieve the petitioner unless the Government has already passed an order before the date of filing of this petition i.e. 02/08/2017 cancelling, varying or modifying the order.

It is made clear that respondents 2 to 4 shall not indulge in unnecessary communication. Unless the order is cancelled, varied or modified by the State Government on or before 02/08/2017, the petitioner will have to be relieved towards compliance of the transfer order.
