The applicant has preferred this first bail application under Section 439 of CrPC, as he is arrested in connection with Crime No.1179/2019, registered at Police Station Durg, District Durg (C.G.), for the offence punishable under Section 420 of IPC. 2.

The applicant has furnished surety before the JMFC, Durg by using the same document of title, which was earlier used for obtaining surety in another offence.

Learned State counsel would oppose the prayer for grant of bail. 4.

Considering the fact that the applicant is in jail since 30.12.2019 and the offence is trialable by the JMFC, this Court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed. The applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court.
