Shri Gary Mukhopadhyay, Govt. Advocate for the State. The present is a repeat bail application. The first bail application was dismissed on 08.12.2017.

The applicant was arrested on 29.07.2017 in connection with Crime No.146 of 2017 registered at Police Station Gariyaband, District Gariyaband, for an offence punishable under Section 20-B of the NDPS Act.

The allegation is that on 29.07.2017 the applicant and two other accused persons were found in possession of 90 KG of Ganja. Learned counsel for the applicant submits that all the material prosecution witnesses have been examined and they have not supported the case of the prosecution, and therefore, the applicant may be released on bail.

However, considering the total facts and circumstances of the case particularly the quantity of contraband seized, this court is not inclined to release the applicant on bail.

The bail application is accordingly rejected. However, it is ordered that the trial court should ensure that the trial is concluded as early as possible.
