Case of the prosecution is that the applicant committed rape against a minor girl.

Learned counsel for the applicant submits that as far as the applicant is concerned, the allegations of applicant committing rape is false. He submits that the applicant and the prosecutrix had an affair and if anything done, it cannot be said to be rape.

On the other hand, learned State counsel opposes bail application and submits that the prosecutrix is a minor as per the story of the prosecution. 5.
