Learned counsel for the applicant submits that this application has been moved because of delay in conclusion of trial. It is submitted that the so called eye witness including the injured witness have not been examined by the prosecution and the witnesses are not turning up. It is further submitted that the applicant is in jail since 07/07/2014.

On the other hand, learned State counsel submits that the order sheets show that on the occasion when the witnessed remained present, the accused were not present and applications are being made. It is submitted that there are allegations of threatening the witnesses.

Taking into consideration the submission of both the parties, particularly taking into consideration that earlier, the bail application was rejected on merits, I am not inclined to grant bail to the applicant at this stage. The application is accordingly rejected.

The Trial Court is directed to expeditiously conclude the Trial at the

earliest. If the injured and eye witness are not examined within a period of four months, the applicant would be at liberty to revive the bail application. Sd/- (Manindra Mohan Shrivastava) Judge Deepti
