Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 23/08/2017 The petitioner has challenged the transfer order mainly on two grounds. Firstly, that the petitioner is going to retire within one year and two months and secondly, that the wife of the petitioner is suffering from various ailments. 2.
Learned counsel for the petitioner submits that if the petitioner is transferred to Surguja, he will suffer hardship.

As far as first ground is concerned, the benefit of seeking indulgence of the Court for transfer to home district is available when one year is left for retirement. Therefore, first ground is not applicable. As far as personal ground is concerned, as the petitioner has already made representation, his representation shall be decided
by the respondents within a period of four weeks from today. 4.
