Chandra Prabha Sonwani v. State Of Chhattisgarh
NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WPS No. 3940 of 2017 Chandra Prabha Sonwani W/o Dr. Umesh Sonwani, Aged About 38 Years Presently Posted As Deputy Director At District Treasury Ambikapur, District Surguja, Chhattisgarh ---- Petitioner
Versus
1. State Of Chhattisgarh Through Secretary Department Of Finance, Mantralaya, Mahanadi Bhawan, Naya Raipur, District Raipur, Chhattisgarh
2. Commissioner, Surguja Division, District Surguja, Chhattisgarh
3. Anil Kumar Bari, Posted As Accounts Officer, Commissioner Office, Ambikapur, District Surguja, Chhattisgarh ---- Respondents Shri Sushobhit Singh, counsel for the petitioner/s. Shri S.P.Kale, Dy.A.G. for the State.
Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 23/08/2017 The petitioner has challenged order dated 14/08/2017 by which, the petitioner has been locally shifted from the District Treasury Office to the office of Divisional Joint Director, Pension Funds and Accounts, Ambikapur as Deputy Director. 2.
Learned counsel for the petitioner submits that the petitioner, though locally shifted, the person who is being brought in place of the petitioner as Senior Treasury Officer, could not be posted as Senior Treasury Officer as he is the officer of the rank of Assistant Director and the post of Senior Treasury Officer could be occupied only by an officer of the rank of Deputy Director. 3.
As far as the petitioner is concerned, she has not suffered legal injury as she has been posted as Deputy Director. It is not even a case that the petitioner has suffered hardship because it is a matter of local shifting in exercise of administrative exigency.
4.
Considering that the petitioner has been posted on the post equivalent to the post of Senior Treasury Officer and that the shifting is not outside the headquarter and it is a local shifting, I am not inclined to interfere with the matter. The petition is accordingly dismissed.
