Heard on the application filed under Section 439 of the Cr.P.C. This is first bail application before this Court filed by the applicant for grant of regular bail. The applicant has been arrested on 12-11-2019 in connection with Crime No.307/2019 registered at P.S. - Out Post Latori, Police Station- Jainagar, Tahsil and District- Surajpur, Chhattisgarh for the offence under Section 363, 366, 376 of the IPC and Section 4 and 6 of the Protection of Children from Sexual Offences Act.

It is submitted on behalf of the applicant that the applicant has been falsely implicated in this case. The applicant is in jail since 12-11-2019. The trial has come to standstill due to lockdown in the circumstances of the Covid19. Therefore, it is prayed that the applicant may be granted bail. 3.
Learned counsel for the State/non-applicant opposes the application on this ground that age of the victim is only 14 years and there is clear statement given by the witnesses against this applicant regarding commission of offence by him. Hence, the application may be rejected.

Heard learned counsel for the parties and perused the documents. 5.
According to the prosecution case, this applicant abducted the minor victim of age 14 years and then has exploited her sexually regarding which the FIR has been lodged.

After considering the facts and circumstances of this case and especially the age of the victim, I am of this view that it is not a fit case for grant of bail to the applicant.

Consequently, this application filed by the applicant under Section 439 of the Cr.P.C. for grant of regular bail is hereby rejected. Sd/- (Rajendra Chandra Singh Samant) Judge Aadil
