1. Proceedings of this matter have been taken-up through video conferencing.
2. Mr.Sabyasachi Bhaduri, learned counsel for the petitioner, would submit that though the petitioner has been granted promotion on the post of Deputy Director, Local Audit Fund, from 4.2.2010, but he is entitled for consideration of promotion on the post of Deputy Director, Local Audit Fund w.e.f. 23.10.2007, for which he has already made representations (Annexures P-8 & P-9), but same have not been considered and decided by respondent No.1 till this date.
3. On the other hand, Mr.Sunil Otwani, learned Additional
Advocate General for the respondents/State, would submit that the petitioner's representation will be considered and decided by respondent No.1 within 45 days from its receipt.
4. Be that as it may, the petitioner is at liberty to make a fresh representation with regard to promotion w.e.f. 23.10.2007 before respondent No.1 within two weeks from today. If such a representation is made, respondent No.1 shall consider and decide the same on its own merit, in accordance with applicable rules and regulations within 45 days from its receipt and to pass a reasoned and speaking order.
5. With the aforesaid observation / direction, the writ petition finally stands disposed of. NO order as to cost(s).
