This is repeat bail application seeking grant of bail to the Applicant who is in jail since 21.09.2016 in connection with Crime No. 109 of 2016 registered at Police Station, Devendra Nagar, District Raipur, for the offence punishable under Section 20-B of the NDPS Act. The earlier bail application was rejected on 14.06.2017. 2.

The present bail application has been filed on the ground of delay in conclusion of trial. However, learned counsel for the applicant, on instructions, submits that by now 9 witness out of 11 have already been examined and only 2 witnesses are left to be examined and they are the departmental witness.

Given the facts and circumstances of the case and the fact that 9 witnesses out of 11 have already been examined, it reflects that trial itself has reached to fag end of its conclusion, and therefore it would not be appropriate at this juncture to grant bail to the applicant. However, it is directed that the court below should ensure that

-2remaining two witnesses to be examined at the earliest and the trial itself is concluded preferably within a period of four months from today.

With the aforesaid observations, the bail application of the applicant stands rejected.
