2. The applicant has preferred this first bail application under Section 439 of CrPC, as he is arrested in connection with Crime No.143/2019, registered at Police Station Darri, District Korba (CG), for the offence punishable under Section 302 of the Indian Penal Code.
3. Applicant has allegedly committed murder of Baliram (since deceased) on 15-10-2019. The applicant has made extra judicial confession in presence of witnesses namely; Suraj
Kewat & Sanjay Kumar Yadav. The iron jack used as weapon for assaulting the deceased has been recovered consequent to the memorandum statement of the applicant.
4. Considering the nature of offence and the evidence collected by the Investigating Officer, this Court is not inclined to grant bail to the applicant at this stage.
5. Accordingly, the bail application is rejected. However, liberty is reserved in favour of the applicant to move again after examination of the witnesses Suraj Kewat & Sanjay Kumar Yadav.
