1. The applicant has been arrested in connection with Crime No.303 of 2017 registered in Police Station- City Kotwali, District- Durg (C.G.) for alleged commission of offence under Section 420 IPC.

2. Case of the prosecution, in brief, is that the applicant cheated number of persons and collected huge amount to the tune of Rs.14 lakh in the name of providing employment.

3. Learned counsel for the applicant would submit that allegation against the applicant are false. No recovery has been made from the applicant and there is no concrete material to show that concerned complainants had actually paid that amount to the applicant. Learned counsel for the applicant would further submit that the applicant is in jail since 15.5.2017 and trial has not been concluded. It is lastly submitted that the complaint has been made after a long

-2delay, therefore, taking into consideration the above circumstances, the applicant may be released on bail.

4. On the other hand, learned counsel for the State, opposing the bail application, submits that in the present case the applicant has recovered huge amount from number of persons in the name of providing employment, therefore, the applicant is not entitled to grant of bail.

5. Taking into consideration the submissions made by learned counsel for the parties, taking into consideration the nature and gravity of offence against the applicant, I am not inclined to grant bail to the applicant.

6. The application is therefore rejected.
