Heard on I.A. No.1/18, which is an application for condonation of delay in filing the CRMP.

On due consideration and being satisfied with the reasons stated in the application the delay of 79 days in filing the CRMP is condoned. Also heard on the application for leave to appeal. Perused the statement of Laxmin Bai (PW-4) & Anita Mahant (PW-5).

Considering the same, leave to appeal is allowed. Registry is directed to register the case as an acquittal appeal. Respondents are directed to furnish the bail bond of Rs.25000/- and surety in the like sum before the learned Court below within a period of one month so that the presence of the respondents can be procured before this Court as and when required.

List this case for final hearing.
