Petitioner has preferred this writ petition for setting aside the gradation list Annexure - P/1 and for a direction to issue fresh gradation list placing the petitioner according to his seniority over and above the respondents No.3 & 4.

At this juncture, learned counsel appearing for the respondents No.2 & 5, Municipal Corporation, Bilaspur and the Commissioner, Municipal Corporation, Bilaspur, respectively, would submit that if the petitioner submits fresh representation, the same shall be considered and decided in accordance with law. 3.

Learned counsel for the petitioner would submit that if the petitioner's representation is decided by a speaking order the petitioner is willing to prefer representation. 4.

Considering the aforesaid submission, the writ petition is disposed of with a direction that in the event petitioner submits fresh representation in the matter within a period of one month from today, the respondents No.2 & 5 shall consider and decide the same in accordance with law and pass necessary speaking order as early as possible preferably within a period of three months from the date of submission of representation.
