The petitioner has preferred this writ petition seeking direction to the respondents No. 2 to 5 to consider his case for giving employment as a part of Rehabilitation, under the State Government Rehabilitation Policy, 2008 (for short 'the Policy, 2008'), on account of acquisition of petitioner's aunt's land for erection of Power Plant, dam project, pipe line and residential house for the purpose of Power Generation in the 2x500 MW, Madwa Tendubhata, Thermal Power Project, Chhattisgarh State Power Generation Company Limited.

2. Learned counsel for the petitioner would submit that the petitioner has filed representation but the same has not yet been considered by the concerned respondents. He would submit that for the present, the concerned respondents may be directed to decide his representation.

In view of the limited nature of relief claimed by the petitioner, at this stage of proceedings, it is directed that if the petitioner submits fresh representation claiming employment in lieu of acquisition of the land for the above stated project, before the competent authority within a period of one month from today, the competent authority of the respondents No. 2 to 5 shall consider and decide his representation by a reasoned order in accordance with the Policy, 2008, as early as possible and preferably within a period of six months from the date of submission of representation. 4.

It is made clear that this Court has not expressed any opinion on the merits of the case and the respondent authorities shall decide the representation, on its own merits, strictly in accordance with law, without treating any observation made in this order, as opinion on the merits of the case.
