Shri Hari Narayan- father of the petitioner was working as Constable/GD in Central Industrial Security Force (CISF), who

died in harness on 07/01/2013, therefore, the petitioner has made an application for appointment on compassionate ground, which has been rejected by orders dated 02/02/2014 & 29/01/2014 merely on the ground that minimum height prescribed by the Home Ministry for the post of Constable/GD is 170 c.m. and in case of petitioner, his height is less than the prescribed parameter i.e. 159.5 c.m. and after giving 7 c.m. relaxation in height, it would be 165.5 c.m., which is less than requisite parameter, therefore, the petitioner is not eligible for the appointment on compassionate ground for the said post.

Learned counsel for the petitioner would submit that he may be considered for other lower post.

On the other hand, learned counsel for the respondents would submit that petitioner has not fulfill requisite qualification particularly height for the post of Constable/GD, therefore, he is not eligible for appointment on compassionate ground. 4.

I have heard learned counsel appearing for the parties. 5.

It is not in dispute that the standard prescribed height for the post of Constable/GD is 170 c.m. and petitioner's height is 159.5 c.m. and even after giving 7 c.m. relaxation in height, he does not fulfill the prescribed height. Thus, the rejection of petitioner's application by the respondent is in accordance with

law and I do not find any illegality in the impugned orders. 6.

Accordingly, writ petition deserves to be and is hereby dismissed.
