Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 05/09/2017 Heard.

1. The petitioner has challenged the transfer order only on the ground that the petitioner is entitled to be given an option for being posted in some other district as he is going to retire on 28.02.2018.

2. Learned counsel for the petitioner is submitted that though the petitioner's home district is Surguja, he is not inclined to continue in his home district but he is willing to give an option for being posted in a nearby district other than his home

district.

3. Taking into consideration the provision contained in clause 1.9 of transfer policy dated 11.07.2017 that the Government servant is going to retire within less than one year, he has to be given an option for being posted in his home district or a district of his choice, it would be appropriate to direct consideration of the petitioner's representation. If the petitioner prefers a representation within a period of 10 days from today, the same shall be considered and decided within a period of four weeks from the date of receipt of copy of this order. For a period of six weeks, no coercive steps shall be taken against the petitioner to compel him to proceed on transfer.

4. The petition is accordingly disposed off.
