On due consideration, delay of 249 days in filing the CRMP is condoned. Accordingly, IA No.1/2020 is allowed. 2.
The Trial Court has acquitted the accused of the charges under Sections 376 (2) (dha), 450 and 506-B of IPC. 3.
The accused was sent for trial for allegedly committing forcible sexual intercourse on promise to marry.

In her deposition, the prosecutrix admits that she had a love affair with the accused, during which she entered into consensual sexual relation with him. She also says that presently she is residing with the accused as his wife.

In view of the statement of the prosecutrix, no case for grant of leave to appeal is made out.
