1. Heard.
2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.6/2020, registered at Police Station Supela Dist. Durg (CG) for the offence punishable under Sections 8/20(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985.
3. Applicant runs a Medicine Shop at Farid Nagar, Imam Bada Chowk, Supela, District Durg. On a raid conducted
at the place adjoining to his medicine shop he was found to have stored for selling several medicines, which contain codeine psychotropic substance. From the applicant's possession 32 bottles of RC Cough Syrup valued at Rs.3,840/-; Spasmoveb+ Capsules 432 pieces and 144 pieces of Spasorid Poxivon Capsules valued at Rs.11,040/- have been recovered.
4. It is argued that the medicine shop does not have enough space to store large quantity of medicine, therefore, the applicant used the adjoining room for storing the goods, which he has purchased as a licensee.
5. Learned counsel appearing for the State would oppose the bail application.
6. Considering the fact that the applicant is in jail since 3-1-2020 i.e. for more than 2 months as also for the fact that the applicant holds the licence for sale of medicine, I am of the opinion that present is a fit case to release the applicant on regular bail.
7. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
