Hon'ble Shri Justice Pritinker Diwaker Order On Board 23/11/2016 Counsel for the respondent submits that identical petition has already been dismissed by this Court vide order dated 05.02.2016 passed in W.P.(L) No. 2713/2011 and therefore similar order be passed in the present petition. The appeal preferred against the direction for payment of Rs. 8,571/- towards gratuity was dismissed by the appellate authority holding that the appeal was time barred.

Considering the amount involved and the absence of any explanation in the pleadings with regard to delay, the Court finds no reason to interfere. The petition is accordingly dismissed.
