Grievance of the petitioner is that the respondent No.2 & 3 they being juniors to the petitioner have been promoted. It is contended that the petitioner do not know that department enquiry or any kind of nature of disciplinary proceeding are pending against the petitioner and therefore no reason exists to deprive the petitioner for consideration of the promotion as without considering the plight of the petitioner, the respondent No.2 & 3 who are juniors have been promoted.

Learned counsel for the petitioner submits that as on today the petitioner has filed an application Annexure P-3 to the Registrar,

Cooperative Societies for consideration of his promotion and if something is not against him then prayer for promotion may also be considered.

Perused Annexure P-3. It do not bears any seal or signature as to when it was received. However, taking into the grievance of the petitioner and the prayer made, if the juniors have been promoted then the petitioner has all the right to know as to what was the condition under which he was not promoted. Furthermore, if nothing exists against the petitioner then naturally he is also entitled to be considered for promotion. Consequently, the petitioner is given liberty to make a fresh detailed representation to the respondent No.1 within a period of 30 days from today and the representation if so filed of the like nature, the same shall be decided within a further period of 60 days from the date of receipt of the representation.
