(2) Learned counsel appearing for the petitioner submits that he may be permitted to withdraw this instant writ petition with liberty to prefer an appeal before the competent authority within a period of 30 days from today.

(3) Prayer appears to be fair and reasonable.

(4) Accordingly, the petitioner is permitted to file an appeal

before the competent authority. If such appeal is filed by the petitioner before the competent authority within a period of 30 days from today, the concerned authority shall consider and decide the same on its own merit and in accordance with law expeditiously from the date of receipt of appeal along with copy of this order.

(5) With the aforesaid observation, the petition stands finally disposed of. No order as to cost(s).
