Shri R.K. Bhagat, Dy. GA Hon'ble Shri Justice Goutam Bhaduri Order On Board 07/03/2019

1. This application under Section 438 of the Code of Criminal Procedure has been filed by the applicants apprehending their arrest in connection with Crime No. 109/2016 registered at Police Station Keshkal, District Kondagaon (C.G.) for the offence punishable under Sections 420, 467, 468, 471, 34 IPC.

2. This is the repeat anticipatory bail application. Prior the anticipatory bail

application bearing M.Cr.C.A. No.1065 of 2016 was filed and the same was dismissed as withdrawn on 15.02.2017 with liberty to approach & surrender before the trial Court and apply for regular bail before the concerned trial Court. It was further observed that if such application is filed, the concerned trial Court shall consider and decide the same on merits as early as possible preferably on the same day. It appears that the said order has not been followed and again this repeat anticipatory bail application has been filed. In view of this, I do not consider it proper to reconsider this repeat anticipatory bail application. Accordingly, the anticipatory bail application is dismissed. Sd/- Goutam Bhaduri Judge Ashu
